Copyright and Intellectual Property Policy
Sound Load Music respects the intellectual property of others, and we ask our users to do the same. When using the Sound Load Music website, products and services you may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Sound Load Music may, in appropriate circumstances and at its discretion, remove or disable access to infringing material, to notify the relevant users that it has removed or disabled access to the material, and to terminate the account of any user who infringes copyright using the Sound Load Music website, products or services. Sending Notice of Copyright or Intellectual Property Infringement If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you MUST provide Sound Load Music's Copyright Agent with the following information (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) of the U.S. Copyright Act to confirm these requirements): 1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest that is allegedly infringed; 2. An identification of the copyrighted work or other intellectual property interest that you claim has been infringed; 3. An identification of the material you claim is an infringement along with enough detail about its location that we may find the allegedly infringing work on the Sound Load Music website or through the Sound Load Music products or services (please include the URL where the infringing material is located on the Sound Load Music website); 4. Your address, telephone number, and email address; 5. A statement by you that you have a good faith belief that the claimed infringement is not authorized by the copyright (or intellectual property) owner, its agent, or the law; 6. A statement by you, made under penalty of perjury, that the above information in your notice to Sound Load Music's Copyright Agent is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf. Please note that under Section 512(f) of the U.S. Copyright Act, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Accordingly, any notification of infringement submitted electronically with an attachment will not be received or processed. Responding To Notices of Infringement If your account has been disabled due to Sound Load Music's receipt of a Notice of Copyright or Intellectual Property Infringement ("Notice of Infringement") described above, and you, in good faith, believe that the original Notice of Infringement submitted against you was wrongfully submitted as a result of a mistake or misidentification of the material to be removed or disabled you may submit a Counter Notice, pursuant to sections 512(g)(2) and (3) of the U.S. Copyright Act, to Sound Load Music's Copyright Agent at one of the addresses shown above. When submitting a Counter Notice to Sound Load Music's Copyright Agent, it is important that the Notice is written clearly and concisely, as well as ensuring that it is compliant with the U.S. Copyright Act's requirements for Counter Notifications. The accuracy and completeness of your Counter Notice will assist Sound Load Music's Copyright Agent in handling your notice effectively and expeditiously. A compliant Counter Notice claiming, under penalty of perjury, that the Notice of Infringement submitted against you was wrongfully submitted as a result of a mistake or misidentification of the material to be removed or disabled MUST contain the following pertinent information in order to be effective and it MUST be submitted to Sound Load Music's Copyright Agent in writing (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) of the U.S. Copyright Act to confirm these requirements): 1. A physical or electronic signature; 2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled; 3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; 4. Your email address, real name, title, mailing address, telephone number and facsimile number if available; 5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Sound Load Music may be found (State of Alabama, County of Coffee), and that you will accept service of process from the person who provided notification under Section 512 (c)(1)(C) of the U.S. Copyright Act or an agent of such person. Please note that under Section 512(f) of the U.S. Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability for damages.
